Mystic Smoke Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Mystic Smoke website, customer accounts, membership program, products, services, and related features.

Mystic Smoke is operated by Endocannex LLC, a California limited liability company (“Mystic Smoke,” “Endocannex,” “we,” “us,” or “our”).

By accessing our website, creating an account, or placing an order, you agree to these Terms.

If you do not agree to these Terms, you should not use our website or purchase our products.

1. Eligibility and Age Requirement

You must be at least 21 years of age to purchase products from Mystic Smoke or create an account intended for purchasing products.

By placing an order, you represent that:

  • You are at least 21 years old;

  • The information you provide is accurate;

  • You are legally permitted to purchase and possess the products ordered;

  • You are purchasing for lawful purposes; and

  • You will comply with applicable laws concerning possession, use, transportation, and transfer of the products.

We may use age-verification procedures or request additional information where appropriate.

We reserve the right to refuse or cancel an order if age or identity requirements cannot reasonably be verified.

2. Legal Compliance and Shipping Restrictions

Mystic Smoke intends to offer and ship products only where we believe doing so is lawful.

Laws governing hemp, cannabinoids, botanical products, and related products vary between jurisdictions and may change.

We reserve the right to:

  • Restrict products by location;

  • Refuse shipment to certain jurisdictions;

  • Cancel orders where we determine shipment may be prohibited;

  • Discontinue products in response to changes in law, regulation, carrier policy, or business requirements.

You are responsible for complying with laws applicable to your possession and use of products after delivery.

However, natural and botanical products may vary between batches.

Website photographs are illustrative and may not perfectly represent the product delivered.

Product availability, specifications, pricing, descriptions, and packaging may change without notice.

4. Product Testing and Information

Where applicable, Mystic Smoke may provide laboratory reports, certificates of analysis, batch information, or other product information.

Laboratory results represent the sample tested and may be subject to reasonable testing tolerances, sampling variation, laboratory methodologies, and natural variation between products or batches.

Customers should review available product information before use.

5. No Medical Advice

Information provided by Mystic Smoke is intended for general informational and commercial purposes.

Statements regarding products, ingredients, cannabinoids, botanicals, aromas, flavors, or potential experiences are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Mystic Smoke does not provide medical advice.

You should consult an appropriate healthcare professional regarding questions involving:

  • Medical conditions;

  • Prescription medications;

  • Drug interactions;

  • Pregnancy or breastfeeding;

  • Workplace drug testing;

  • Sensitivities or allergies; or

  • Other health concerns.

Individual responses to products may vary.

6. Orders

Submitting an order does not guarantee acceptance.

We reserve the right to refuse, limit, or cancel orders for reasons including:

  • Product availability;

  • Pricing or listing errors;

  • Suspected fraud;

  • Payment issues;

  • Age-verification issues;

  • Shipping restrictions;

  • Legal or regulatory concerns;

  • Suspected resale or abuse;

An order is considered accepted when it has been processed for fulfillment, subject to applicable law.

7. Pricing

Prices are displayed in U.S. dollars unless otherwise stated.

We may change prices at any time.

Price changes do not ordinarily affect orders already accepted.

Despite reasonable efforts, pricing or promotional errors may occasionally occur.

If an obvious pricing error is discovered before shipment, we may:

  • Contact you for approval of the corrected price; or

  • Cancel the affected item or order and provide any refund required for the canceled merchandise.

Taxes, shipping charges, and other applicable charges may be added at checkout.

8. Payments

You agree to provide current, complete, and accurate payment information.

By submitting payment information, you represent that you are authorized to use the selected payment method.

Payments may be processed by third-party payment providers.

We may use transaction, address-verification, fraud-detection, identity-verification, and similar information when evaluating orders.

We reserve the right to decline or cancel transactions reasonably suspected of fraud or unauthorized payment activity.

9. Shipping

Shipping and delivery dates are estimates unless expressly stated otherwise.

Once a shipment has been transferred to a carrier, transportation and delivery may be affected by circumstances outside Mystic Smoke's control.

Detailed rules regarding:

  • Shipping delays;

  • Lost packages;

  • Packages marked delivered;

  • Incorrect addresses;

  • Replacement shipments; and

  • Shipping-related claims

are governed by our Return, Replacement & Shipping Policy, which is incorporated into these Terms by reference.

10. Returns, Replacements, and Refunds

Due to health, safety, product-integrity, and legal considerations, Mystic Smoke generally does not accept physical returns once products have been shipped.

Eligible product or fulfillment problems are generally resolved through replacement rather than refund.

Issues potentially eligible for replacement may include:

  • Defective products;

  • Contamination reasonably attributable to the product;

  • Incorrect products;

  • Missing products;

  • Fulfillment errors;

  • Certain damaged products; or

  • Lost shipments meeting our applicable requirements.

Except where Mystic Smoke approves otherwise or applicable law requires a different remedy, refunds are generally unavailable after shipment.

11. Customer Accounts

You may have the option to create a Mystic Smoke customer account.

You are responsible for:

  • Maintaining accurate account information;

  • Protecting your login credentials;

  • Restricting unauthorized access to your account; and

  • Promptly informing us of suspected unauthorized access.

You may not impersonate another person or create accounts using fraudulent information.

We may suspend or terminate accounts involved in fraud, abuse, unauthorized activity, or violation of these Terms.

12. Membership and Rewards Program

Mystic Smoke may offer a membership or rewards program through which eligible customers can receive:

  • Points;

  • Discounts;

  • Promotional offers;

  • Member pricing;

  • Referral benefits;

  • Early access;

  • Special offers; or

  • Other benefits.

Participation is voluntary.

Unless expressly stated otherwise:

  • Points have no cash value;

  • Points cannot be exchanged for cash;

  • Points are personal to the applicable account;

  • Points may not be sold;

  • Points may not ordinarily be transferred;

  • Rewards may be subject to restrictions;

  • Points may be adjusted for canceled, disputed, fraudulent, or otherwise invalid transactions; and

  • Program benefits may change.

13. Promotions and Coupons

Promotions, coupons, discounts, and special offers may be subject to additional terms.

Unless otherwise stated:

  • Promotions cannot be combined;

  • Promotions have no cash value;

  • Promotions may be limited to one use;

  • Promotional periods may end without extension;

  • Certain products may be excluded;

  • Minimum-purchase requirements may apply; and

  • Promotions may not be transferred or resold.

We may cancel or deny promotional benefits obtained through fraud, technical manipulation, duplicate accounts, or other abuse.

14. Chargebacks and Payment Disputes

If you believe there is a problem with an order, we encourage you to contact Mystic Smoke so that we can investigate the issue.

Filing a payment dispute does not eliminate valid obligations associated with an order.

We may provide relevant transaction information to payment processors, banks, card networks, fraud-prevention providers, or other parties involved in resolving a payment dispute.

Such information may include:

  • Order records;

  • Transaction records;

  • Address-verification results;

  • Customer communications;

  • Shipping records;

  • Tracking information;

  • Proof of delivery;

  • Account activity; and

  • Other information reasonably relevant to the dispute.

Fraudulent or abusive chargeback activity may result in account restrictions or refusal of future transactions.

Nothing in this section prevents a customer from exercising lawful rights relating to unauthorized or disputed transactions.

15. Prohibited Uses

You may not use the website or our services to:

  • Commit fraud;

  • Violate applicable law;

  • Provide false information;

  • Circumvent age restrictions;

  • Interfere with website security;

  • Attempt unauthorized access to systems or accounts;

  • Introduce malicious software;

  • Scrape or harvest information without authorization;

  • Manipulate rewards or promotional systems;

  • Abuse chargeback procedures;

  • Impersonate another person;

  • Infringe intellectual-property rights; or

  • Interfere with the operation of Mystic Smoke.

We may restrict access or terminate accounts for prohibited activity.

16. Intellectual Property

The Mystic Smoke website and its contents may include intellectual property owned by or licensed to Endocannex LLC.

This may include:

  • Mystic Smoke branding;

  • Logos;

  • Product names;

  • Product descriptions;

  • Photographs;

  • Graphics;

  • Packaging designs;

  • Website designs;

  • Written content;

  • Videos;

  • Formulas or product information;

  • Software;

  • Databases; and

  • Other materials.

Except as permitted by law or expressly authorized in writing, you may not reproduce, distribute, modify, sell, commercially exploit, or create derivative works from our intellectual property.

Personal, noncommercial use of the website is permitted.

17. Reviews, Feedback, and Submitted Content

If you voluntarily provide reviews, photographs, feedback, suggestions, or other content, you represent that you have the right to provide that content.

You grant Mystic Smoke a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute submitted content for legitimate business and marketing purposes, subject to applicable privacy law.

We are not obligated to publish customer-submitted content.

We may remove content that is:

  • Unlawful;

  • Fraudulent;

  • Misleading;

  • Abusive;

  • Infringing;

  • Spam;

  • Unrelated to the product or service; or

  • Otherwise inappropriate.

We will not prohibit or suppress legitimate negative reviews merely because they are unfavorable.

20. Product Use and Assumption of Responsibility

Customers are responsible for using products responsibly and in accordance with applicable product information and law.

You should not use a product if you have reason to believe doing so would be unsafe for you.

Products capable of causing impairment should not be used before or while:

  • Driving;

  • Operating machinery;

  • Performing hazardous activities; or

  • Engaging in activities requiring unimpaired judgment or coordination.

Keep products securely stored and away from children and animals.

Do not transfer products to individuals who are underage or otherwise prohibited from possessing them.

21. Drug Testing

Certain products may contain cannabinoids or related compounds that could result in a positive drug test.

Mystic Smoke does not guarantee that use of any product will not affect a drug-screening result.

Customers subject to employment, athletic, probationary, military, governmental, medical, or other drug testing assume responsibility for evaluating whether use of a product is appropriate.

22. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the website and services are provided on an “as is” and “as available” basis.

Except for warranties that cannot legally be excluded, Mystic Smoke disclaims implied warranties including warranties of:

  • Merchantability;

  • Fitness for a particular purpose; and

  • Non-infringement.

We do not guarantee that:

  • The website will operate without interruption;

  • Information will always be free of error;

  • Every product will remain continuously available; or

  • A particular customer will experience a particular subjective effect from a product.

This section does not eliminate warranties or consumer rights that cannot legally be waived.

23. Limitation of Liability

To the fullest extent permitted by applicable law, Mystic Smoke and Endocannex LLC shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the website or services.

Where liability cannot legally be excluded, liability shall be limited only to the extent permitted by law.

Nothing in these Terms excludes liability that cannot legally be disclaimed or limited.

24. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Endocannex LLC and Mystic Smoke from third-party claims, damages, liabilities, or expenses arising from your:

  • Unlawful use of our products;

  • Violation of these Terms;

  • Fraudulent activity;

  • Infringement of third-party rights; or

  • Misuse of the website or services.

This provision does not require consumers to indemnify Mystic Smoke for Mystic Smoke's own unlawful conduct.

25. Suspension and Termination

We may suspend or terminate access to an account or service where reasonably necessary because of:

  • Fraud;

  • Abuse;

  • Security concerns;

  • Violation of these Terms;

  • Unlawful activity;

  • Rewards manipulation;

  • Threats or harassment;

  • Payment fraud; or

  • Other material misuse.

Termination of an account does not eliminate rights or obligations arising before termination.

26. Changes to Products or Services

We may modify, discontinue, replace, or limit products, membership benefits, promotions, website features, or other services.

We do not guarantee that any particular product or feature will remain available indefinitely.

27. Changes to These Terms

We may revise these Terms as our business, website, membership program, products, or legal obligations change.

Material changes will apply prospectively to the extent required by law.

The effective date at the beginning of these Terms identifies the current version.

When appropriate, we may provide additional notice of material changes.

28. Governing Law

These Terms shall be governed by the laws of the State of California, except where applicable law requires otherwise.

Any dispute relating to these Terms shall be subject to the jurisdiction of an appropriate court as permitted by applicable law.

Nothing in these Terms limits a consumer's rights under applicable federal, state, or local consumer-protection laws.

29. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in effect.

An invalid provision shall be limited or modified only to the extent necessary to make it enforceable where permitted by law.

30. No Waiver

Failure by Mystic Smoke to enforce a provision of these Terms does not waive our right to enforce that provision in the future.

31. Entire Agreement

These Terms, together with applicable policies incorporated by reference, constitute the agreement governing your use of Mystic Smoke services.
